Bank regulators run by Trump-appointed leaders could move to issue a revised proposal on capital requirements for large banks, according to FDIC Vice Chairman Travis Hill.

The regulator said in an amicus brief Wednesday that home equity investments can be considered credit and subject to Truth in Lending Act requirements.

The company allegedly failed to fully cooperate with state regulators following a data breach.

The manufactured home builder allegedly made loans for borrowers while knowing they could not afford to pay back the loan.

The regulator estimates that the move will prompt a jump in mortgage originations. The rule is largely unchanged from an earlier proposal despite concerns raised by mortgage companies.

“We can continue to expect [states] to be as active and maybe even more so this time around,” said Kathryn Ryan, a partner at Orrick.

Regulators in some states controlled by Democrats are poised to increase their oversight of consumer protection laws as the CFPB’s focus is expected to shift under the incoming Trump administration.

The bureau’s fall regulatory agenda listed December as the date for issuing three final rules among several other items. None of the items has been issued so far.

The state’s proposal to establish Community Reinvestment Act requirements for nonbank mortgage lenders was met with opposition from the Mortgage Bankers Association.
