Several consumer protection statutes provide borrowers a private right of action, including the Truth in Lending Act.

The lawsuit covers the Consumer Financial Protection Bureau and the Department of Housing and Urban Development, among other agencies.

The CFPB plans to dismiss its case against Townstone and reverse a settlement the parties reached last year.

Following a court ruling last week, the CFPB and HUD reinstated hundreds of probationary employees fired by the Trump administration. However, the employees were immediately placed on administrative leave.

Just before the vote, Sen. Elizabeth Warren, D-MA, released the CFPB nominee’s answers to a series of questions regarding the bureau. Warren said his responses were filled with “non-answers that regurgitated the agency’s obligations under the law.”

Several CFPB offices have been authorized to continue working, but the process has been filled with confusion between new bureau leadership and bureau employees.

The House Financial Services Committee voted 30-19 to pass a Congressional Review Act resolution to reverse a CFPB final rule that will limit overdraft fees charged by large banks and credit unions.

Prices are expected to rise for homebuilders, mortgage companies and consumers as the Trump administration implements new tariffs.

The CFPB director nominee detailed plans for the bureau at his Senate confirmation hearing last week.

"Nothing about the current CFPB situation changes the fundamental obligation [of lenders] to collect and report lending data," said Kareem Saleh, CEO of FairPlay.
