CA Lawmakers Ponder Curbs on ’Private AG’ Power to Bring Suit

The California legislature is considering proposed measures to curb alleged litigation abuses that often victimize small businesses, including mortgage and settlement service providers. The measures are all aimed at amending the “private attorney general” provision of California’s Unfair Competition Law. The statute prohibits “unlawful, unfair and fraudulent” business practices, as well as false and misleading advertisements.
