Mortgage banking attorneys are cautioning mortgage servicers to be mindful of three general requirements and other unsettled servicing questions under the Real Estate Settlement Procedures Act that could get them in trouble with regulators or the plaintiffs’ bar. There are also new litigation trends to watch out for on the servicing side, warned Scott Lundberg of Utah-based Lundberg & Associates, a law firm that represents mortgage lenders and servicers in foreclosure and bankruptcy cases.
