Virginia chartered mortgage lenders could face another legal fight if the U.S. Supreme Court decides to consider whether the federal parity act overrides state prepayment laws. The Virginia Bureau of Financial Institutions and the state attorney general are preparing a joint brief seeking to overturn federal preemption of state law limiting prepayment penalties charged by state-chartered mortgage lenders. They have until May 7 to file a request with the court.
