Plaintiff lawyers are testing new class action strategies in anti-predatory lending cases in an effort to extend lender liability deeper into the secondary mortgage market. The good news is defense lawyers are succeeding in getting most of the cases dismissed early. The bad news is plaintiff lawyers are filing new cases faster than the courts can throw them out.
