Two recent court rulings have upheld the ability of subprime lenders to enforce arbitration contracts, avoiding the potential for lengthy and costly litigation. At issue in both Randolph v. Green Tree Financial and Lytle v. CitiFinancial was the issue of whether aggrieved borrowers can pursue classwide relief in arbitration. Labeled "oppressive" by consumer advocates, mandatory arbitration clauses have also been targeted by state and federal lawmakers in a number of anti-predatory lending initiatives. But
