Credit insurers should not have to honor their obligations concerning loan-backed securities if they can show that originators covered up prior default rates on the loans, the credit insurer Royal Indemnity is arguing in a lawsuit that will be decided by a federal appeals court. If investors are concerned about risks associated with asset-backed securities, Royal argues, they can choose to pay for real financial guaranty insurance rather than credit risk insurance.
