The Federal Communications Commission has codified a long-standing policy for excluding certain faxed messages from federal prohibition of unsolicited commercial faxes. The codification of the “established business relationship” standard became the cornerstone of revised final rules announced by the FCC early this month. The new rules implement the Junk Fax Prevention Act of 2005, which bars companies from faxing unsolicited advertisements without first obtaining a written permission from the recipient.
