Federally chartered lenders must not deny credit to loan applicants whose credit reports contain fraud or active-duty alerts, the Federal Deposit Insurance Corp. warned last week. In FIL-22-2006, the FDIC made clear that such discriminatory action is prohibited by the Equal Credit Opportunity Act, including situations in which a consumer exercised his or her right under the Consumer Credit Protection Act. ECOA outlaws lending discrimination on a number of prohibited bases.
