Federally chartered lenders doing business within the jurisdiction of the U.S. Court of Appeals for the 9th Circuit may not use federal preemption to ward off an employment discrimination complaint filed under state law. In a Dec. 23 ruling, a 9th Circuit appeals court ruled that a Washington state law on age discrimination is not preempted by the National Bank Act.
