There are situations when a borrower in default decides to oppose the mortgage lender or broker and racks up a huge amount of legal fees. Let’s say the borrower at some point decides to hang up the gloves and reinstate or pay off the mortgage. The borrower then cuts a check for the remaining principal and interest, but “forgets” to include the legal fees. What should the lender do?
