The Mortgage Bankers Association will ask federal regulators to consider an industry proposal that would ease lenders’ concerns about “adverse action” notice requirements under the Fair and Accurate Credit Transactions Act, or the FACT Act. The MBA said the adverse-action notice requirement is causing anxiety among lenders, fearing that the uncertainty in the statutory language will increase liability risk.
