Healthy and well-managed national banks may make non-controlling investments in an enterprise, including a mortgage reinsurance company, as long as its activities are “substantially the same” as those approved before by the Office of the Comptroller of the Currency. The OCC made the clarification in Interpretive Letter 985 in response to a bank’s inquiry about direct or indirect investments in a mortgage reinsurer.
