Federally chartered thrifts do not have to comply with New York state law requiring payment of interest on mortgage escrow accounts, according to the Office of Thrift Supervision. Responding to a recent inquiry regarding New York’s authority to regulate escrow accounts, the OTS made clear that the federal Home Owners’ Loan Act preempts state law. The agency has rendered similar opinions in the past.
