Federal banking regulators took action against a Texas bank for allegedly charging subprime borrowers excessive loan fees and for services that were never performed. By bringing the complaint under the Federal Trade Commission Act – the first time any federal banking regulator has done so – the Office of the Comptroller of the Currency has sent a strong message to opponents of federal preemption, according to industry observers.
