The Department of Housing and Urban Development has limited authority to recast the good-faith estimate as planned under the RESPA reform rule and could lose in a lawsuit challenging the new GFE, according to legal experts. Congress worded RESPA in a way that gave authority to create a GFE disclosure document, not authority to create remedies, experts said.
