State-chartered creditors shouldn’t fret at the loss of federal preemption under the Alternative Mortgage Transaction Parity Act, as a result of new federal regulation that kicks in on July 1. The fact that a state may prohibit or limit prepayment fees does not necessarily mean that such prohibition or limitation applies to a particular loan, industry lawyers say.
