Offering lenders immunity from RESPA liability in exchange for a guaranteed closing cost package may be beyond the authority of the Department of Housing and Urban Development, the ranking member of the House Financial Services Committee warned. In a letter last week to HUD Secretary Mel Martinez, Rep. John LaFalce, D-NY, expressed doubt whether HUD can legally make such deals with lenders through its upcoming rule on RESPA reform.
