A coalition of settlement service providers, title attorneys and related businesses are objecting to provisions in the Department of Housing and Urban Development’s 2001 policy statement that appear to impose a cap on direct consumer charges. Attempting to use the Real Estate Settlement Procedures Act’s fee-splitting provision to regulate direct consumer charges would create uncertainty and unleash a flood of litigation, the coalition warned in a white paper submitted to HUD last month.
