Mortgage subsidiaries that claim they are “banks” may not be able to find safe harbor under the Gramm-Leach-Bliley Act’s privacy provisions if they violate state consumer fraud law. Last month, a federal district court judge in Minnesota threw out Fleet Mortgage Corp.’s motion to dismiss after ruling that the company did not meet the GLB Act’s provisions that exempt banks and its subsidiaries from the Federal Trade Commission Act.
