The Department of Justice will require more proof of discrimination other than "statistical disparities" before filing a fair lending or predatory lending complaint against a financial institution, according to a top department official. Although concerned about the disproportionate concentration of subprime loans in minority areas, including high-income black neighborhoods, the Justice Department knows that statistical disparities alone do not necessarily reflect racial discrimination or bias, said Assistant Attorney General for Civil Rights Ralph Boyd.
