Non-Agency Mortgage Sector Fared Moderately Better in Early 2014; ARM Lending Holds Firm

All the major mortgage product categories saw declines in new originations during the first quarter, but the jumbo and home-equity sectors held up slightly better, according to a new ranking and analysis by Inside Mortgage Finance. The conventional-conforming sector took the biggest hit, as new production dropped 25.9 percent from the fourth quarter of 2013 to an estimated $123 billion in the first three months of this year. Warehouse Usage Rates the Weakest in Years, ‘Mini Correspondent’ Programs Gaining Steam

Banks that extend warehouse lines of credit to nonbank originators saw their commitment levels fall 39 percent in the first quarter compared to the same period a year earlier, yet another sign that the origination market was extremely weak during the first three months of 2014. On a sequential basis, commitments dropped a more benign 10.8 percent, but it’s not unusual for some firms to keep a line open, even if they’re not utilizing their power to borrow. New MBS Margin Requirements May Be a New Liquidity Glitch for Some Mortgage Bankers

New margin rules for broker-dealers may trip up mortgage bankers using mortgage-backed securities to hedge their businesses, according to experts discussing various liquidity issues during last week’s Secondary Market Conference sponsored by the Mortgage Bankers Association. Fannie Mae has traditionally reserved the right to invoke margin calls if the government-sponsored enterprise needed to, even before the Treasury Practices Market Group issued new best practices on the subject, said Renee Schultz, a Fannie vice president, but this right was rarely used. Expert: GSE Shareholder Suits at ‘Early Stage’ of a Long Process; Litigation No Barrier to Dissolution, Says Group

Look for the various lawsuits filed by private owners of Fannie Mae and Freddie Mac stock against the federal government to take a “very long time to be decided,” as the courts may take up to a year to resolve just the introductory motions, according to a legal expert. Beyond that, the litigation over shares in the two government-sponsored enterprises could stretch out to the U.S. Supreme Court. Momentum Builds for the GSEs to Be Preserved, FHFA Seen as New Leader on Mortgage Policy

A lack of overwhelming support in the Senate for legislation to reform the government-sponsored enterprises has shifted the housing finance policy debate from reform to preservation. If Congress fails to act, the Federal Housing Finance Agency is set to drive mortgage policy for years to come. Sens. Tim Johnson, D-SD, and Mike Crapo, R-ID, initially delayed the Senate Committee on Banking, Housing, and Urban Affairs’ recent markup of S. 1217, the Housing Finance Reform and Taxpayer Protection Act, in an effort to increase support for the GSE reform bill. Industry Groups Voice Support for President’s Choice of Donovan’s Successor to Lead HUD

Two trade groups expressed their support for the nomination of Department of Housing and Urban Development Secretary Shaun Donovan to be the director of the Office of Management and Budget and Julian Castro as his successor at HUD. The Mortgage Bankers Association praised Donovan for his work on critical initiatives, such as housing revitalization, recovery efforts related to Hurricane Sandy, borrower assistance programs and the HUD/FHA budget.
