Industry lawyers are concerned that more class actions could result from last week’s decision by the U.S. Court of Appeals for the 2nd Circuit to reinstate plaintiffs’ claims in a case alleging that a lender violated the Real Estate Settlement Procedures Act by marking up third-party fees.
