Federal law preempts state anti-predatory laws regardless of whether state consumer protections are triggered at loan origination or upon default on a high-cost loan, the Office of Thrift Supervision said in an opinion that raises the bar on federal preemption. The OTS opinion on New Mexico’s Home Loan Protection Act significantly expands the previous basis used by the agency to preempt similar legislation in Georgia, New York and New Jersey.
