Foreclosure of a mortgage loan can be enforced even though the underlying note might be unenforceable, according to a Connecticut superior court. In Home Equity v. Jensen (CV-04-4001381), the New London Superior Court found the mortgage to be a separate instrument from the note, which is also given separately. As such, terms and conditions are enforceable when the note is not time-barred, the court said.
