Courts Reject Plaintiffs’ Attempts to Hold Assignees Liable Under North Carolina Law

Assignees of mortgage loans have been able to fend off several recent attempts to hold them liable under North Carolina’s deceptive practices laws. The legal theories used to defeat these claims in the Tar Heel State may be useful to MBS purchasers everywhere, as class-action lawyers continue to search for new victims.
