State Legislative Changes Could Get Georgia Subprime Mortgage Market Rolling Again

Georgia has enacted substantial amendments to its controversial anti-predatory lending statute that have cleared the way for securities rating agencies to begin reviewing deals backed by subprime mortgage loans from the state. The revised Georgia Fair Lending Act covers a much smaller swath of the mortgage market than its predecessor did and – key for the secondary markets – virtually eliminates the assignee liability
