SEC Grants Special Treatment for ABS Issuers in New Management Certification Requirement

The Securities and Exchange Commission this week issued special guidance for entities that issue asset-backed securities on how they should comply with new officer certification requirements imposed by the Sarbanes-Oxley Act of 2002. While the SEC didn’t go along with industry arguments that ABS issuing structures should be excluded from the new certification requirements, the agency did agree that special rules should apply.
